Our Service provides users with the ability to purchase “credits,” which can be redeemed to create or generate custom audio affirmations. These digital audio affirmations are delivered electronically within our platform based on the user’s input or preferences.

2. Eligibility

To access or use our Service, you must be at least the age of majority in your jurisdiction (e.g., 18 years old in most countries). By using the Service, you represent and warrant that:

You are at least the age of majority in your jurisdiction.
You have not been previously suspended or removed from the Service.
Your registration and use of the Service is in compliance with all applicable laws and regulations.

3. User Accounts

You may be required to create an account to access certain features of our Service. When creating your account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Purchases, Credits, and Payment

You agree to pay all fees associated with the purchase of credits, including any applicable taxes or fees. We use third-party payment processors (e.g., Stripe, PayPal) to process payments. By submitting payment information, you authorize us to store and process your information with these third-party processors.

Each credit may be redeemed within our platform to generate a single custom audio affirmation, unless otherwise stated. Credits are non-transferable and non-refundable once purchased, except as required by law or explicitly stated in these Terms.

5. Expiration of Credits

Credits may expire if not used within a specified period, as indicated at the time of purchase or in your account dashboard. We reserve the right to modify the expiration policy at any time. Any unused credits after the expiration date may be forfeited without compensation.

6. Creation and Delivery of Custom Audio Affirmations

Once you redeem credits to generate a custom audio affirmation, the content will be created based on your input, preferences, or other relevant data you provide. Delivery of the custom audio affirmations typically occurs immediately or within a specified timeframe outlined on our website.

7. Refund Policy

We want you to be completely satisfied with your purchase. If you're not happy for any reason, you can request a full refund within 24 hours of your purchase—no questions asked.

To request a refund, please contact us at support@affirmup.app with your account email and order details. We'll process your refund promptly.

Refunds are usually completed within 3–5 business days, but the exact timing depends on your payment provider and their processing policies.

After 24 hours, refunds are generally not available unless there was a technical issue (e.g., undelivered or unusable audio). In such cases, reach out and we’ll be happy to help.

8. License & Intellectual Property

All content on AffirmUP—including audio affirmations, designs, text, code, and branding—is protected by copyright, trademark, and other intellectual property laws.

When you purchase or generate content on AffirmUP, we grant you a personal, non-exclusive, non-transferable license to use it for your own private, non-commercial purposes. This means you're welcome to listen, download, and enjoy your affirmations—just not to sell, share publicly, or re-use them for commercial gain.

You may not copy, modify, distribute, or create derivative works from any part of the platform without our written permission.

9. Prohibited Conduct

You agree not to:

Use the Service for any illegal or unauthorized purpose.
Share, distribute, or reproduce any digital goods in a manner that infringes intellectual property rights.
Violate any laws, rules, or regulations in your jurisdiction.
Interfere with or disrupt the Service or servers/networks connected to the Service.

10. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content will be accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by applicable law or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill. The total liability arising out of or related to these Terms shall not exceed the amount you paid for the credits in question.

12. Modifications to the Service and Prices

We reserve the right to modify or discontinue the Service (or any part thereof) without prior notice. Prices for credits are subject to change without notice, and we reserve the right to modify them at any time.

13. Termination

We may terminate or suspend your account and/or access to our Service immediately, without prior notice or liability, if you breach these Terms or for any other reason as determined by us in our sole discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of EU, without regard to conflict of law provisions. Any disputes arising out of these Terms or the Service shall be resolved in the courts of EU.

15. Changes to Terms

We reserve the right, at our sole discretion, to update, modify, or replace any part of these Terms by posting updates or changes on our website. It is your responsibility to check these Terms periodically for changes. Your continued use of or access to the Service following the posting of any changes constitutes acceptance of those changes.
